ELIGIBILITY REQUIREMENTS: The Contest is open to residents of the United States who are eighteen (18) years of age or older at time of entry ("Contestant"). Only one entry per person.

Employees, contractors, directors and officers of the American Council on Exercise ("Sponsor"), and the immediate family members of each (spouse, parent, child, sibling, grandparent, and spouse or "step" of each, regardless of where they reside) and those living in their same households are not eligible to enter or win. The Contest is void outside of the geographic areas listed above, and the Contest is void anywhere else where prohibited by law. Subject to all applicable federal, state, and local laws and regulations. Participation constitutes Contestant's full and unconditional agreement to these terms and conditions and Sponsor's decisions, which are final and binding in all matters related to the Contest.

Entry with Purchase: Each Contestant will receive one entry upon the purchase of an American Council on Exercise 24-Month CEC Power Pass between September 15, 2022 and September 30, 2022. Only one entry per person.

Free Method of Entry: You may receive an entry without making a purchase by sending a post card printed by hand with your name, mailing address, day and evening phone numbers, email address and mailing it with proper postage to "ACE CEC Power Pass Contest", American Council on Exercise, 9444 Balboa Ave. Suite 290, San Diego, CA 92123-4901. Only one entry per person. All postcard entries must be postmarked by September 30, 2022 and received by October 5. Sponsor is not responsible for incomplete, inaccurate or what they deem to be illegible entry forms. Multiple entries, entries that are incomplete, inaccurate or what Sponsor deems to be illegible are forfeited.

Entry Period - The Contest period begins on September 15, 2022, at 12:01 a.m. and ends on September 30, 2022, at 11:59 p.m., Pacific Time (the "Entry Period").

Prize Winner Announcement - On or about November 16, 2022, Sponsor will announce and notify the first and last name and the city, and state of residence of the four winners. Such first and last name, city and state of residence will be posted at www.acefitness.org/contest/. For purposes of clarification, you specifically acknowledge and understand that the potential Prize Winners shall not become the actual Prize Winner unless and until his/her eligibility to participate in the Contest has been verified.

GENERAL CONDITIONS: The winner is solely responsible for any federal, state and local taxes on his/her prize. No substitution of any prize is offered, except at the sole discretion of the Sponsor. No transfer of prize is permitted. Sponsor reserves the right to substitute a prize (or portion thereof) with another prize of equal or greater value. By participating, entrants agree to these Official Rules and Sponsor's Privacy Policy (available at http://www.acefitness.org), which are final and binding in all respects. An unclaimed prize will not be awarded. The prize winner is subject to verification of eligibility and compliance with these Official Rules. The prize will be awarded by a link sent by the fulfilment company for Sponsor approximately six weeks after the end of the Entry Period. If a prize is returned as undeliverable or cannot be awarded for any reason, prize will be forfeited and may be awarded to an alternate winner. If for any reason the Contest is not capable of running as planned, including, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right, at its sole discretion, to disqualify any individual who is responsible or who tampers with the entry process and void all associated entries, and to cancel, modify or terminate the Contest. In the event of cancellation, the prize will be awarded in a random drawing from all eligible, non-suspect entries received as of the time of cancellation. This Contest is offered only in the United States and is governed by the laws of the state of California, and all claims must be resolved in the federal or state courts in San Diego County, California.

LIMITATIONS OF LIABILITY AND RELEASE: No liability or responsibility is assumed by the Sponsor resulting from Contestant's participation in, attempt to participate in the Contest. No responsibility or liability is assumed by the Sponsor for technical problems or technical malfunction arising in connection with any of the following occurrences, without limitation, that may affect the operation of the Contest: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any e-mail transmissions to be sent to or received; lost, late, delayed or intercepted e-mail transmissions; unauthorized human or non-human intervention of the operation of the Contest, including without limitation, unauthorized tampering, hacking, theft, virus, bug, worm; or destruction of any aspect of the Contest. Sponsor is not responsible for any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on the Web Site or other Contest-related materials. By participating in the Contest, the Contestant releases the Sponsor from any and all claims, damages or liabilities arising from or relating to Contestant's participation in the Contest. By accepting a prize, winner agrees to release and hold Sponsor, and all of their respective officers, directors, employees, representatives and agents harmless from and against, any liability for injuries, losses or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Contest; from acceptance, possession, misuse or use of a prize; and any liability for taxes, duties or other levies assessed upon any of the prizes. Except if the winner is a resident where prohibited by law, by accepting prize, winner grants permission for Sponsor and those acting under its authority to use his/her name, photograph, voice and/or likeness, for advertising and/or publicity purposes, in any and all media now known or hereinafter invented without territorial or time limitations and without additional compensation, notification or permission. Caution: Any attempt by a participant to deliberately undermine the legitimate operation of the Contest is a violation of Criminal and Civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages and any other remedies (including Attorney's fees) from any participant to the fullest extent permitted by law.

MISCELLANEOUS: The sole and full copyright ownership in and to the Contest and all accompanying materials belongs to Sponsor. All rights in and to the Contest and such materials are reserved by Sponsor.
